Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Who Sent That Text Message website and service (the "Service") operated by DNS Publishing, LLC d/b/a Who Sent That Text Message, a consumer service powered by VeriRoute Intelligence ("us", "we", "our", "Company").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service. Your access to and use of the Service is also conditioned on your acceptance of and compliance with our Privacy Policy, Cookie Policy, and End User License Agreement (EULA).

2. Description of Service

Who Sent That Text Message provides phone number lookup services that may include carrier information, caller identification (CNAM), geographic location data, line type identification, and spam/fraud risk assessment. The Service is provided for lawful purposes only.

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is available only to users in the United States.

4. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any applicable federal, state, local, or international law or regulation
  • Stalk, harass, threaten, or harm any individual
  • Engage in any form of discrimination or hate speech
  • Conduct any debt collection activities
  • Make decisions about employment, housing, credit, insurance, or other similar purposes regulated by the Fair Credit Reporting Act (FCRA)
  • Locate individuals for purposes of inflicting harm
  • Circumvent any access controls or usage limits
  • Resell, redistribute, or sublicense the Service or any data obtained through it
  • Use automated means (bots, scrapers, etc.) to access the Service without our express written permission
  • Attempt to reverse engineer, decompile, or extract source code from our Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Collect or harvest any personally identifiable information from the Service

6. FCRA Disclaimer

IMPORTANT: Who Sent That Text Message is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), and the information provided through our Service does not constitute a "consumer report" as defined by the FCRA. You may not use our Service or any information obtained from it to determine an individual's eligibility for:

  • Credit or insurance for personal, family, or household purposes
  • Employment purposes
  • Tenant screening
  • Any other purpose authorized under the FCRA

7. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring monthly or annual basis depending on the subscription plan you select.

Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current billing period. You may cancel your subscription at any time through your account settings.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

8. Refund Policy

We offer refunds on a case-by-case basis. If you are not satisfied with our Service, please contact us within 7 days of your purchase. Refunds are not guaranteed and are at our sole discretion. Lookups that have already been performed are non-refundable.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of DNS Publishing, LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

10. Data Accuracy Disclaimer

While we strive to provide accurate and up-to-date information, we make no warranties or representations regarding the accuracy, completeness, or reliability of any information provided through our Service. Phone number data changes frequently, and information may be outdated, incomplete, or inaccurate. You should not rely solely on our Service for any critical decisions.

11. Limitation of Liability

IN NO EVENT SHALL VERIROUTE INTELLIGENCE, LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

13. Indemnification

You agree to defend, indemnify, and hold harmless DNS Publishing, LLC and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or your violation of these Terms.

14. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue therein.

16. Arbitration Agreement

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The place of arbitration shall be Delaware. The arbitration shall be conducted in English. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

CLASS ACTION WAIVER: YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

17. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
